SUCCESSFUL IMPLEMENTATION OF PERMISSION FOR ARTISTS’ STUDIOS, COMMUNITY USE AND 27 RESIDENTIAL APARTMENTS

Through submission of a Certificate of Lawful Use application supported with robust evidence and with a detailed case referencing the planning history of the site and relevant case law relating to the interpretation of conditions precedent, Hume Planning were able to successfully demonstrate that earlier operational works undertaken by the client did indeed constituted a lawful implementation of development pursuant to historic permissions. This decision was reached despite a negative planning position prior to our involvement.

The grant of the certificate has unlocked a long standing planning stalemate to enable the implementation of development constituting the erection of three and four storey buildings to create a mixed use development of 27 residential apartments, artists’ studios, café and community meeting facilities – within the currently derelict site of Sopers Yard. This implementation of this permission will improve the setting of the adjacent Grade II Listed ‘Tudor House’ and further the regeneration objectives of Margate Old Town.
